These Terms of Service govern access to the website magnetainer.store, use of its features and purchases made from the Magnetainer online store.

Please read these Terms carefully before using the website or placing an order.

Throughout these Terms, “Magnetainer,” “we,” “us” and “our” refer to the merchant identified above.

2. Application and Acceptance of These Terms

These Terms apply to:

• access to and use of the Magnetainer website;

• orders placed through the Magnetainer online store;

• products purchased directly from Magnetainer; and

• website features, content and services made available by Magnetainer.

By placing an order, you confirm that you have had the opportunity to review these Terms and the policies expressly presented or made available to you before checkout.

The Refund and Return Policy, Shipping Policy and Privacy Policy form part of the terms applicable to a purchase when they are presented or expressly brought to the customer’s attention before the order is completed.

In the event of a conflict, mandatory consumer protection legislation takes precedence over these Terms.

3. French and English Versions

A French version of these Terms is available to customers.

Customers in Québec must be provided with the French version before choosing expressly to be bound by the English version.

Where both versions have been validly made available and the customer has expressly chosen English, the English version will apply, subject to mandatory applicable law.

4. Eligibility and Legal Capacity

To place an order, you must have the legal capacity to enter into a contract in your province or territory of residence.

A person who has not reached the applicable age of majority may place an order only with the authorization and supervision of a parent or legal guardian.

You agree to provide complete, current and accurate information when placing an order.

5. Permitted Use of the Website

You may use the website only for lawful personal or commercial shopping purposes.

You must not:

• use the website or a product for an unlawful purpose;

• attempt to gain unauthorized access to the website, its systems or customer accounts;

• upload or transmit malware, malicious code or harmful content;

• interfere with the security or normal operation of the website;

• use automated systems to copy, scrape or overload the website without authorization;

• impersonate another person or provide fraudulent information;

• infringe the intellectual property, privacy or other legal rights of Magnetainer or a third party; or

• use the website to conduct fraudulent payment activity.

Magnetainer may restrict access to the website where reasonably necessary to protect customers, prevent fraud, maintain security or comply with the law.

6. Product Information

Magnetainer takes reasonable measures to provide accurate product descriptions, photographs, dimensions, colours, specifications and other product information.

The colours displayed on a screen may vary slightly depending on the device, display settings and lighting. Such minor display differences do not permit Magnetainer to provide a product that is materially different from its description, photographs or representations.

Measurements may be subject to minor manufacturing variations where clearly disclosed and reasonable for the type of product.

Products delivered to customers must conform to the applicable product description, representations and mandatory legal warranties.

Magnetainer may modify or discontinue a product for future sales. Such a change does not permit Magnetainer to modify or cancel an existing contract except with the customer’s agreement or where permitted by law.

7. Orders and Contract Confirmation

Before submitting an order, customers are given an opportunity to review and correct their selected products, quantities, delivery address and payment information.

After an order is completed, Magnetainer will provide an order confirmation containing the applicable transaction information in a form that the customer can reasonably retain.

An order may be refused before a contract is concluded where:

• payment authorization fails;

• the information provided is incomplete or cannot reasonably be verified;

• the transaction is reasonably suspected to be fraudulent;

• the order would violate an applicable law; or

• delivery to the stated address is not reasonably available and this is disclosed before acceptance.

Once a contract has been validly concluded, Magnetainer will not cancel it merely because a product is no longer available or because Magnetainer intended to display a different price.

Where Magnetainer is legally unable to perform an order, it will contact the customer promptly and provide the remedy required by applicable law.

8. Prices, Taxes and Charges

Unless clearly stated otherwise, all prices displayed on the Canadian store are in Canadian dollars (CAD).

Product prices may change for future orders without prior notice. A price change will not affect a contract that has already been validly concluded.

Before an order is completed, the customer will be shown:

• the price of each product;

• applicable discounts;

• applicable delivery charges;

• applicable federal and provincial sales taxes;

• the total amount payable; and

• any other charge that Magnetainer is legally required to disclose.

No additional amount will be charged by Magnetainer after the order without the customer’s authorization, except where permitted or required by law.

9. Promotions and Discount Codes

Promotions, bundles and discount codes are subject to the conditions displayed with the applicable offer.

Unless otherwise expressly stated:

• discount codes have no cash value;

• discounts apply only during the stated promotional period;

• discounts cannot be applied retroactively;

• only discounts identified as combinable may be used together; and

• a refund will be based on the amount actually paid for the refunded product.

Where part of a discounted bundle is returned, the refund may be recalculated according to the terms disclosed in the Refund and Return Policy.

Nothing in this section limits a mandatory consumer right.

10. Payment

Payments may be processed through third-party payment service providers, including Shopify Payments and PayPal.

The availability of payment methods may vary depending on the customer’s location, device and order.

By submitting payment information, you confirm that:

• the information is accurate;

• you are authorized to use the selected payment method; and

• you authorize the applicable charge for the total amount displayed at checkout.

Payment service providers may process information according to their own terms and privacy practices.

Magnetainer does not guarantee that every payment method will always be available.

11. Shipping and Delivery

Magnetainer currently delivers to eligible addresses within Canada.

The available shipping method, applicable shipping charge and estimated delivery period will be displayed before the order is completed.

Delivery times are estimates based on the information reasonably available at the time of purchase. Weather, transportation interruptions and other events outside Magnetainer’s reasonable control may affect delivery.

The use of a third-party carrier does not eliminate Magnetainer’s obligations toward the customer.

If a package is delayed, lost, damaged or incorrectly delivered, contact Magnetainer at contact.magnetainer@gmail.comwith the applicable order information.

Nothing in these Terms limits a customer’s statutory right to cancel an online purchase or obtain another remedy when an order is not delivered within the period prescribed by applicable law.

Customers are responsible for providing an accurate and complete delivery address. Where delivery is prevented solely by the customer’s incorrect information, refusal to accept the package or other negligent act, Magnetainer may apply the reasonable procedures and charges disclosed in the Refund and Return Policy.

12. Returns, Refunds and Cancellations

Voluntary returns, refunds, damaged products, incorrect products and cancellation requests are governed by the Magnetainer Refund and Return Policy.

The voluntary return policy is offered in addition to, and not in replacement of, any mandatory legal warranty, cancellation right or remedy.

Where applicable law grants the customer a specific right of cancellation or reimbursement, Magnetainer will comply with the legally prescribed conditions and deadlines.

13. Legal Warranties

Products sold by Magnetainer are subject to the mandatory legal warranties applicable in the customer’s province or territory.

For customers in Québec, products must, among other things:

• be fit for the purpose for which products of that kind are ordinarily used;

• be durable for a reasonable period, considering their price, contractual terms and conditions of use;

• conform to their description, advertising and representations; and

• be free from latent defects as provided by applicable law.

Nothing in these Terms excludes, restricts or replaces a mandatory legal warranty.

14. Website Availability

Magnetainer takes reasonable measures to maintain the operation and security of the website.

The website may occasionally be unavailable because of maintenance, updates, technical problems, cybersecurity measures, failures affecting a third-party service provider or circumstances outside Magnetainer’s reasonable control.

Magnetainer does not guarantee uninterrupted access to every non-essential website feature.

This section does not limit Magnetainer’s obligations concerning a purchase already concluded or any liability that cannot legally be excluded.

15. Third-Party Services and Links

The website may contain integrations, tools or links operated by Shopify, payment providers, delivery providers, social media platforms or other third parties.

Magnetainer does not control independent third-party websites. Access to an external website may be subject to the third party’s own terms and privacy policy.

Magnetainer is not responsible for the independent content or operation of an external website outside its reasonable control.

This provision does not remove any responsibility Magnetainer may have for a third party it uses to perform its own contractual obligations.

16. Intellectual Property

Unless otherwise indicated, website content created by or for Magnetainer, including original text, branding, logos, photographs, videos, graphics and designs, is owned by or licensed to Magnetainer.

Certain trademarks, software, photographs, applications and other materials may belong to Shopify, suppliers, service providers or other third parties.

You may view and use website content for personal shopping purposes.

You may not reproduce, modify, distribute, sell, publish or commercially exploit protected content without authorization from the applicable rights holder, except where permitted by law.

17. Limitation of Liability

To the extent permitted by applicable law, Magnetainer is not responsible for indirect or consequential losses that were not reasonably foreseeable and that result solely from circumstances outside its reasonable control.

Nothing in these Terms excludes or limits:

• liability arising from intentional or gross fault;

• liability for bodily or moral injury;

• liability that cannot legally be excluded or limited;

• mandatory legal warranties;

• obligations arising from a product that does not conform to the contract; or

• any mandatory right or remedy granted by consumer protection legislation.

No provision of these Terms should be interpreted as requiring a customer to waive a right that cannot legally be waived.

18. Personal Information

The collection, use, disclosure, retention and protection of personal information are governed by the Magnetainer Privacy Policy and applicable privacy legislation.

19. Changes to These Terms

Magnetainer may update these Terms for future website use and future purchases.

The date of the latest revision will be displayed at the beginning of the Terms.

Unless permitted by law or accepted by the customer, an amendment will not retroactively change the terms of an order that was already concluded.

An existing purchase remains governed by the version of the Terms and policies applicable when the order was completed.

20. Severability

If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited only to the extent necessary under applicable law.

The remaining provisions will continue to apply unless the invalid provision is essential to the contract as a whole.

21. Governing Law and Consumer Rights

These Terms are governed by the laws applicable in the Province of Québec and the federal laws of Canada applicable therein.

Nothing in these Terms deprives a consumer of the mandatory protections available under the laws applicable in the consumer’s province or territory of residence.

Nothing in these Terms requires a consumer to waive access to a court or consumer protection authority that has jurisdiction under applicable law.
